PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 15 April 1999, Orders 105-0011, DA, HQ, 3 rd Infantry Division (Mechanized) and Fort Stewart, GA; discharged the applicant from the Regular Army, effective 22 April 1999. The record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty) which was authenticated by the applicant’s signature. His DD Form 214 indicates that he was discharged under the provisions of Chapter 14, AR 635-200, by reason of misconduct-commission of a serious offense with a characterization of service general, under honorable conditions. The specific facts and circumstances leading to the applicant’s discharge are not contained in the available records.

         b. On 22 April 1999, the applicant was discharged with a general, under honorable conditions discharge. At the time of discharge, the applicant had completed 3 years, 9 months, and 17 days of active military service.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

          a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

          b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

 (1) The issue is rejected. The Board carefully examined the applicant’s record of service during the period of enlistment under review and heard his testimony. There was a full consideration of all faithful and honorable service as well as the infractions of discipline, the extent thereof, and the seriousness of the offenses. The applicant’s record is void of facts and circumstances concerning events that led to a discharge from the Army, however, the applicant testified that he received two Article 15s, for use of marijuana and LSD, respectively. Although the applicant also testified that he did not knowingly ingest LSD, he did not provide any independent corroborating evidence in support of this contention. In the absence of evidence to the contrary, the Board presumed government regularity in the discharge process. The applicant had the duty to support and abide by the Army's drug policies and he knowingly risked a military career and diminished the quality of service below that meriting a fully honorable discharge by testing positive for drugs on two occasions. The Board found no evidence of arbitrary or capricious actions by the command. The Board, being convinced that the reason for discharge and the characterization of service were proper and equitable, voted to deny relief.
